We reserve the right to change the Terms and Conditions at any time by posting on the Website without further notice. Major changes will be communicated accordingly. Please check back periodically as use of the site implies agreement with the current version.

  1. Do not abuse the site by introducing viruses, malicious material or attacks (e.g. DDoS). Violation may constitute a criminal offense; we will report you to the authorities and recover damages.
  2. We reserve the right to suspend or terminate access if use violates the Terms or is harmful.
  3. If you copy or download content in an unauthorized way, return or destroy the copies upon our request and provide proof.

1. AVAILABILITY AND DEFECTS
  1. The Site may be unavailable or contain errors; it is provided on an "as is" and "as available" basis, without warranties, to the extent permitted by law.
  2. We are under no obligation to update the information, except as required by law.
  3. We reserve the right to modify, delete, suspend or discontinue the site, information, products or services, temporarily or permanently.
2. DEFINITIONS AND TERMS
  1. BucuriaCasei: The brand under which we offer our services as a pet brokerage agency. We present offers from breeders and collect commission from the customer on commission. Bucuria Casai Online SRL, CUI 42245898, Reg. Com. J2020000293080
  2. Breeder/owner: Natural or legal person who breeds and keeps pets supplied to the Agency's clients.
  3. Customer: Natural or legal person using the services of Bucuria Casei.
  4. Pet: Purebred dogs and cats listed on the site.
  5. WebsiteDomain www.bucuriacasei.ro and its subdomains.
  6. Contract: These Terms and Conditions.
  7. Offer: Personalized e-mail or advertisement on the website, including total price (escalating fee + agency commission).
  8. Comment: Critical or appreciative comment on a review or other comment.
  9. Question: Request information about animals or services.
  10. Answer: Written information given in response to a question.
3. RIGHTS AND OBLIGATIONS OF THE PARTIES
Breeder
  1. It is responsible for the quality and health of the animals, provides up-to-date pictures and delivers as ordered.
  2. Transport the animal in optimal conditions to the county town indicated by the client.
  3. Provides vaccinated, microchipped, health-recorded animals at least 8 weeks old.

BucuriaCasei
  1. Ensures fulfillment of the breeder's obligations (including delivery of the breed, sex and color requested in the order).
  2. Checking Breeders and Animals: We are committed to verify the collaborating breeders, the living conditions of the animals, the health and compliance of the animals with the client's requirements, working with authorized veterinarians.
  3. Providing Transparent Information: We provide customers with pictures, videos and full details of the chickens checked, for an informed choice.
  4. Organizing Safe Transport: We arrange the transportation of animals in optimal conditions, in Romania or specified countries, clearly communicating the date and place of delivery.
  5. Continuing Assistance: We offer support to customers before, during and after delivery, including advice on pet care and integration.
  6. Medical Guarantee: We provide medical cover for specified viral illnesses (e.g. Parvovirus) as per section 6, subject to the conditions stated.
  7. Right to Refuse Orders: We reserve the right to refuse or cancel orders if the customer's requirements cannot be met or if there is suspicion of abuse.
  8. Limitation of liability: We are not responsible for defects or hidden diseases of the animal occurring after the warranty period or for damage caused by them or by customer negligence.

Customer
  1. He can cancel the order and recover the commission according to section 8 (Cancel Order).
  2. Pay the difference in price directly to the breeder on delivery.
  3. Checks animal's condition on delivery and health within 5 calendar days; provides documentation if problems arise.
  4. After 5 days, it is responsible for the safety and health of the animal.
  5. May be accompanied by a specialist (vet etc.) on delivery.
  6. Can refuse the animal within 48 hours if it does not meet specifications (breed, sex, color).
  7. Pay the breeder the difference indicated in the order upon delivery and check the amount.
  8. If the amount exceeds the offer, it may refuse payment and notify the agency for enforcement of financial obligations.
  9. Inform the agency immediately (maximum 12 hours) if the animal's health deteriorates during the guarantee period.
  10. From the moment of actual handover of the pet to the Client (or to the person authorized by the Client to take over the pet), the Client shall be fully responsible for the welfare, supervision and care of the pet, subject to animal welfare legislation and this Agreement, subject to the medical guarantee described in Section 6.
  11. Immediately upon receipt, the customer commits:
    1. to take the animal directly to its home (or to the location established as its permanent place of residence), providing it with comfort, quiet, adequate temperature and a safe resting place;
    2. provide the animal with fresh water and food appropriate to its age and the recommendations communicated by the Joy of Home / breeder, and check that the animal is eating no later than 4 (four) hours after delivery;
    3. monitor the animal closely in the first 24-72 hours after delivery, at a minimum:
      - Activity level and general behavior (alert, playful, interested in the environment);
      - apparent clinical condition (not lethargic, no tremors, shortness of breath, vomiting, etc.);
      - stool appearance (no diarrhea, no blood or mucus, no repeated episodes of diarrhea).
  12. Especially in the first week after delivery, the client undertakes not to subject the animal to unnecessary stressors such as (but not limited to):
    1. long-distance transportation, additional to delivery transportation;
    2. exposure to crowds, loud noise or events (parties, loud music, fireworks, etc.);
    3. contact with large numbers of unfamiliar people or animals;
    4. repeated changes of location in a short time.
  13. If, after delivery, the customer observes any signs of illness or worrisome changes in the animal's condition (lack of appetite, listlessness/lethargy, diarrhea, vomiting, blood in the stool, difficulty breathing or other similar symptoms), he/she is obliged to:
    1. to contact emergency a veterinarian; and
    2. to announce immediately Bucuria Casei (by phone, WhatsApp or e-mail), sending details, photo/video and, subsequently, the medical documents (consultation form, investigations, diagnosis). Failure to notify the BucuriaCasa agency within 12 hours maximum, refusal to submit the requested medical documents or failure to follow the communicated care instructions will result in the client assuming all consequences and the guarantee will be void.
  14. The client undertakes not to defame The Joy of the House, its services, its collaborating breeders or the animals provided, in the public space (including social networks, review sites, forums or any medium accessible to the public).
    1. Defamation includes any false, denigrating or damaging statements that harm the reputation or image of Bucuria Casei, according to Article 253 of the Romanian Civil Code.
    2. A breach of this clause will result in a contractual penalty of €5,000, payable immediately to Joy of Home, without limiting the right to further compensation for actual damages.
    3. The penalty shall be activated upon written notification of the Home Enjoyment and the customer waives any dispute as to its proportionality by accepting it as part of the contract.
4. INVOICING AND PAYMENT
  1. Payment of the commission (10% advance) is made through the website by confirming your order.
  2. The customer receives the invoice after the commission has been paid to Joy of Home.
  3. The difference in price is paid directly to the breeder on delivery, for which the agency does not issue tax documents and is not responsible.
  4. We reserve the right to adjust prices without prior notice.
5. DELIVER
  1. Delivery to Romania or selected countries in Europe, according to offer.
  2. The animal is transported safely, minimizing stress.
  3. The customer is notified of the date and place of delivery.
  4. If delivery is delayed for reasons beyond our control, we are not liable for damages.
  5. For pedigree dogs, the document can take up to 3 months to be issued, which is why it will be sent by express courier, and the delivery of the puppy is not conditional on it.
  6. From the moment the pet is handed over to the client (or his authorized representative), the breeder's and Joy of Home's obligation to deliver the pet is considered fulfilled. From that point, the risks and responsibility for the well-being, supervision and care of the pet shall remain with the Client, subject to the medical guarantee set out in Section 6.
6. MEDICAL GUARANTEE
  1. We offer guarantee for specific viral diseases (Parvovirus, Jigodie, Hepatitis, Leptospirosis or Rabies) for 5 days after delivery.
  2. The customer should check the health at an authorized veterinarian during this period.
  3. If covered problems are confirmed, we offer replacement or refund commission excluding additional costs.
  4. The Guarantee does not cover illnesses or complications caused by the Client's post-delivery negligence, including, but not limited to: failure to follow care recommendations, failure to provide a suitable living environment, exposure to excessive stressors, sudden changes in feed, or delay in veterinary consultation in the event of the onset of symptoms described in Section 3 („Client”).
7. CONFIDENTIALITY AND DATA PROTECTION
  1. We collect personal data under GDPR; see Privacy Policy on the website.
  2. Data is used for order processing, marketing (with consent) and service improvement.
  3. We do not sell data to third parties; we secure information against unauthorized access.
8. CANCEL THE ORDER
  1. The customer can cancel the order under the following conditions:
    1. The order is less than 14 days old;
    2. The order was more than 30 days over the estimate on the ordered breed page (for dogs without pedigree) or the agreed upon pick-up time;
    3. The order is more than 30 days past the 6-month deadline (for pedigree dogs) or the deadline agreed when the order was taken.
  2. No refund will be given if, although you meet one of the above conditions, you have already chosen the animal you want and have reserved it for you.
  3. Failure to contact the customer or failure to respond to the customer's choice of dog or to arrange delivery details will result in the order being canceled and the commission withheld.
  4. Failure of the client to show up at the place and time agreed with the breeder or transporter, or refusal to pick up or pay for the animal, leads to the cancellation of the order and withholding of the commission.
  5. Cancellation by the customer after providing the information or contact details of the breeder/owner of the animal will result in the commission being withheld.
  6. If the customer is eligible and requests a refund of the commission, it will be refunded in the same way, within 14 days of the request. The amount refunded will be 20 lei less than the amount charged (bank commission).
9. DISPUTES AND APPLICABLE LAW
  1. Any dispute is settled amicably; otherwise, through the competent Romanian courts.
  2. These Terms are governed by Romanian law.
